Early in the month, defendants in the Zantac litigation submitted their appeal to the Delaware Supreme Court. Their argument centers on claims that plaintiffs’ experts failed to prove a specific “threshold dose” linking ranitidine or NDMA to cancer. Plaintiffs counter, asserting that Delaware law allows for a broader interpretation of scientific evidence, unlike the rigid MDL approach.

 

In related news, GSK has agreed to a $2.2 billion settlement to resolve nearly 80,000 Zantac lawsuits, covering 93% of pending claims. The agreement, expected to be implemented in 2025, does not include cases against Boehringer Ingelheim.

 

The second week of the month saw the start of a high-stakes bladder cancer trial against Boehringer Ingelheim in Oakland. The defense claims secondhand smoke and weight caused the plaintiff’s cancer, not Zantac. With bladder cancer strongly linked to NDMA, this trial could finally secure a much-needed victory for plaintiffs.
